1. Introduction​

Welcome to DEFINE Coaching: Performance & Rehabilitation (“DEFINE”, “we”, “our”, “us”), the trading name of SPC Physio Care.

 

These Terms & Conditions apply to all memberships, services, physiotherapy treatments, digital products, store purchases, and access to our facilities.

 

By purchasing any plan, product, or service, or by entering our facility, you confirm that you have read, understood, and agreed to these Terms.

 

Continued use of our services constitutes acceptance of the most current version of these Terms.

 

2. Membership Plans & Pricing

2.1 Non Auto-Renewing Plans

 

All membership pricing plans purchased through our website or payment gateway are fixed-term and do not automatically renew.

 

Members must manually purchase a new plan if they wish to continue after their current plan expires.

 

Access expires automatically at the end of the purchased period.

 

2.2 Plan Durations

Monthly Membership: 30 consecutive days

3-Month Membership: 3 consecutive calendar months

6-Month Membership: 6 consecutive calendar months

 

Access is valid only during the active plan period.

 

2.3 Early Cancellation of Multi-Month Plans

Early cancellation is permitted only if the next month has not started.

 

If cancellation occurs:

• 6-Month Plan will be recalculated at the 3-Month rate for months used.

• 3-Month Plan will be recalculated at the Monthly rate for months used.

Any refund will reflect the difference between the recalculated rate and the amount originally paid.

​

Once a month has started, it is considered used and non-refundable.

​

2.4 No Cooling-Off Period

Membership plans do not include a 7-day cooling-off period.

 

Members may use the Freeze Policy outlined in Section 3.

3. Membership Freeze Policy

3.1 Eligibility

One freeze is permitted per purchased membership cycle.

 

3.2 Duration

• Minimum freeze:

  • 7 days

• Maximum freeze:

  • 30 days for Monthly and 3-Month plans

  • 60 days for 6-Month plans

​

Freeze requests must be submitted before the freeze period begins and cannot be backdated.

​

Freezes do not extend beyond the maximum duration permitted per plan.

​

4. Online Store Purchases

4.1 Collection Only

All items purchased through the DEFINE Coaching online store are collection only.

​

DEFINE Coaching does not provide shipping or delivery services.

​

Customers are responsible for collecting items during designated collection hours.

​

Risk and responsibility for the item transfer to the customer at the time of collection.

​

4.2 Collection Timeframe

Items must be collected within 14 days of purchase unless otherwise agreed in writing.

​

Uncollected items may be cancelled and refunded at management discretion.

​

4.3 Store Returns & Refunds

Returns are accepted within 7 days of purchase provided that:

​

• The item is unused

• The item is unworn

• The item is in original condition

• Proof of purchase is provided

​

Refunds will be issued to the original payment method.

​

The following are non-refundable:

• Used or worn items

• Personalised or custom products

• Sale or clearance items (if stated)

• Digital products

DEFINE Coaching reserves the right to refuse returns that do not meet these conditions.

​

5. Digital Products

All digital products are final sale and non-refundable.

​

Digital products are downloadable for personal use only.

​

Unless otherwise stated, digital purchases include lifetime access.

​

Users may not copy, distribute, resell, reproduce, or commercially exploit digital content.

​

Unauthorised use may result in legal action.

​

6. Payment Failures

If payment fails for any service or plan:

​

Access will not be granted or will be suspended immediately.

​

Access will resume only upon successful payment.

​

DEFINE Coaching reserves the right to refuse access where payment disputes are ongoing.

​​

7. Age Requirements

Minimum age for independent gym use is 16 years.

 

Under 16s may enter only when accompanied by a paying adult who assumes full responsibility for their safety, conduct, and supervision.

8. Health & Safety

8.1 Health Declaration

Members confirm they are medically fit for physical activity.

​

Members must disclose injuries, medical conditions, or limitations that may affect safe participation.

​

Failure to disclose relevant medical information may result in termination without refund.

​

8.2 Medical Disclaimer

Physiotherapists and staff operate within their professional scope of practice.

​

DEFINE Coaching does not replace medical doctors or emergency medical services.

​

Members participate in physical activity at their own risk.

​

9. Assumption of Risk

Members acknowledge that strength training, conditioning, rehabilitation, and functional fitness involve inherent risks.

​

These risks include but are not limited to:

• Muscle strain

• Ligament or tendon injury

• Joint damage

• Falls

• Equipment malfunction

• Cardiovascular events

​

Members voluntarily assume full responsibility for all risks associated with training, including during unmanned operating hours.

​

10. Limitation of Liability

To the fullest extent permitted by law, DEFINE Coaching and SPC Physio Care shall not be liable for:

• Personal injury arising from exercise or equipment use

• Injury sustained during unmanned hours

• Improper use of equipment

• Loss, theft, or damage of personal belongings

• Indirect or consequential damages

Liability, where legally applicable, shall be limited to the value of the membership or service purchased.

​

Nothing in these Terms excludes liability where exclusion is prohibited by law.

​

11. Member Responsibility & Equipment Use

Members are solely responsible for:

• Ensuring they understand how to use equipment safely

• Training within their capabilities

• Using spotters when required

• Inspecting equipment before use

• Reporting defective equipment

​

Members are liable for damage caused by negligent, reckless, or deliberate misuse of equipment.

​

Repair or replacement costs may be charged accordingly.

​

12. Facility Code of Conduct

Members must:

• Respect staff and members

• Return equipment to its correct place

• Clean equipment after use

• Wear appropriate training attire

• Follow access and safety rules

• Avoid unauthorised coaching

• Comply with Women’s-Only area restrictions

• Supervise children where applicable

Violation may result in suspension or termination without refund.

​

13. CCTV & Surveillance

The facility operates CCTV monitoring for safety and security.

​

By entering the facility, members consent to being recorded.

​

Footage may be reviewed for incident investigation and may be shared with law enforcement if required.

​

14. Biometric Data & Access Control

DEFINE Coaching uses biometric access systems.

​

By registering for access, members consent to:

• Collection and storage of biometric identifiers

• Use of biometric data for entry management

​

Biometric data will not be sold or shared except where required by law.

​

15. Chargebacks & Payment Disputes

Members agree not to initiate unjustified chargebacks.

​

Members must contact DEFINE Coaching to resolve disputes before contacting their bank.

​

Fraudulent or unjustified chargebacks may result in termination and recovery of associated costs.

​

16. Termination Without Refund

DEFINE Coaching reserves the right to terminate membership immediately and without refund for:

• Sharing access credentials

• Allowing unauthorised entry

• Harassment or misconduct

• Damage to property

• Breach of safety rules

• Falsification of health information

• Illegal behaviour

17. Intellectual Property

All branding, programs, materials, and content remain the intellectual property of DEFINE Coaching and SPC Physio Care.

​

Unauthorised reproduction or commercial use may result in legal action.

​

18. Force Majeure

DEFINE Coaching shall not be liable for service interruptions caused by events beyond reasonable control, including:

• Government restrictions

• Public health emergencies

• Natural disasters

• Power outages

• Civil disturbances

​

No compensation shall be owed for such interruptions.

​

19. Governing Law

These Terms are governed by the laws of the Sultanate of Oman.

​

Any disputes shall be subject to the jurisdiction of Omani courts.

​

20. Entire Agreement

These Terms constitute the entire agreement between DEFINE Coaching and the member.

​

No verbal statements override these Terms.

​

21. Severability

If any provision is found unenforceable, the remaining provisions remain valid.
